For claims under $10,000, the arbitration will be conducted based on written submissions unless either party requests an in-person hearing. For claims of $10,000 or more, either party may request a hearing. The filing fees and costs of arbitration shall be borne as provided by the AAA Consumer Arbitration Rules. Each party shall bear its own attorneys' fees unless the arbitrator determines otherwise.
30-Day Right to Opt Out of Arbitration

Your notice must include your name, mailing address, and a clear statement that you wish to opt out of binding arbitration. Class Action Waiver
You agree to resolve disputes with us on an individual basis only. You waive any right to participate in class action lawsuits, class-wide arbitration, or any other representative proceeding against TopInkjet. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Informal Resolution
Before initiating arbitration, you agree to first contact us by email at [email protected] to attempt to resolve the dispute informally. We will work in good faith to resolve any dispute amicably within 30 days.
Small Claims Court
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits.
Venue for Non-Arbitrated Claims
Any dispute not resolved through arbitration shall be brought exclusively in state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
Shipping and Delivery
TopInkjet ships exclusively within the United States. Free standard ground shipping is included on every order. Delivery times are estimates and not guaranteed. Title and risk of loss to products pass to you when the carrier takes possession of the product for shipment. We are not responsible for delays caused by shipping carriers, weather conditions, or other factors beyond our reasonable control.
